Terms of Publication

If one or more of your submissions are chosen for inclusion in the 40 Years of Gen Con book, your name will be listed in the credits and Trident, Inc. d/b/a Atlas Games will provide you with one complimentary copy of the book as consideration for your contribution. Limit 1 complimentary copy per person. Complimentary copies may be picked up in person by the contributor at the gift shop during Gen Con Indy 2007, or will be mailed after the convention.

All submissions must be entered by Monday, April 2nd, 2007 to be considered for publication.

Submissions will also be rated by visitors to the GenConHistory.com website, with two new subject topics being opened for submissions each week until Monday, March 19th, 2007. Each topic will remain open for submissions and voting for two weeks. If one of your submissions is ranked as the top story or photo on a topic, Gen Con LLC will provide you with a complimentary 4-day badge to Gen Con Indy 2007. Badges are non-transferable; Limit 1 complimentary badge per person. If you are already pre-registered for a badge when your submission is selected, Gen Con LLC will refund your pre-registration payment. In the case of a tie, the recipient of the badge in question will be determined at random. We reserve the right to disqualify and remove submissions and comments for any reason.

All submissions for a particular subject topic must be entered by Noon CST on its deadline date (as listed in the forum) to be considered for a complimentary badge.

TERMS OF PUBLICATION -- STORIES

Submission constitutes an Agreement between the author (hereinafter called "Author") and Trident, Inc. d/b/a Atlas Games (hereinafter called "Atlas Games"), whose principal place of business is at 885 Pierce Butler Route, St. Paul, MN, 55104, with respect to your story (hereinafter called the "Work") for "40 Years of Gen Con" (hereinafter called the "Title"), the working title of a non-fiction book.

Whereas, Author desires to receive consideration in return for Author hereby assigning to Atlas Games all of AuthorĂ­s rights of any nature whatsoever in said Work; Whereas, Atlas Games is willing to make such consideration to Author in return for said assignment by Author; Now, therefore, the parties agree as follows

1. Nature of Contract

The parties hereby expressly agree that the Work will be developed by and original to Author and is hereby specially ordered and commissioned by Atlas Games and shall be considered to be a work made for hire owned by Atlas Games. If, for any reason, the Work is held not to constitute a work made for hire, it is expressly agreed that the assignment of all rights by this Agreement will nevertheless remain in full force and effect.

2. Author's Warranty

Author warrants to Atlas Games that the Work is innocent and contains no matter contrary to law; that the Work has not been published previously and that the Work is not being considered for publication by any other publisher; and that Author has not made any prior commitments in conflict with this Agreement. Author warrants further that the Work is original and does not infringe upon any statutory copyright, common law right, right of privacy, or proprietary right of any sort other than such rights of Atlas Games or such rights licensed by Atlas Games from third parties. The Author will defend, indemnify, and hold harmless Atlas Games against all claims, suits, costs, damages, and expenses that Atlas Games may sustain by reason of any scandalous, libelous, or unlawful matter contained or alleged to be contained in the Work, or any infringement or violation by the Work of any copyright or property right; and until such a claim or suit has been settled or withdrawn, Atlas Games may withhold any sums due the Author under this Agreement.

3. Assignment of Author's Rights

In return for consideration by Atlas Games to Author for design and development of the Work, which total consideration is acknowledged to be good and sufficient, Author hereby agrees to assign to Atlas Games, upon creation of Work, absolutely and forever, all rights, title, and interest throughout the world in and to the Work and any derivative works thereof, including, but not by way of limitation, (a) the copyright and the right to secure copyright thereon and all extensions and renewals of copyright throughout the world (b) the title and story thereof, including all rights in the names and illustrations, and (c) all rights therein of every kind now and hereafter known or recognized.

4. Derivative Works

Author agrees that by this complete assignment Atlas Games hereby purchases all rights in said Work and has the exclusive right to prepare derivative works based on said Work. Author hereby agrees that he releases Atlas Games, and all others who derive title or any rights from Atlas Games, from having any obligation whatsoever to Author in regard to any Work (existing or which may hereafter be created) which might be deemed to be a derivative work based upon the Work.

5. Consideration to Author

In full consideration for all AuthorĂ­s agreements, warranties, and services to be rendered hereunder, Atlas Games agrees to provide the Author without charge one (1) copy of the printed Work within thirty (30) days after the public release of the published version of the Work.

6. Publishing Details

Atlas Games will have the right to edit, develop and otherwise alter the Work for the original printing and for any reprinting. Atlas Games will have the right to publish the Work at its own expense in such style, form, and manner and at such price as it deems suitable.

7. Credit

Contributor credit shall be given in the Title by Atlas Games to Author upon publication of the Title.

8. Construction, Heirs, Modification

This agreement shall be construed and interpreted according to the laws of the State of Minnesota. Paragraph headings are included for convenience only and shall not be referred to in the interpretation of this Agreement. Whenever the context may require, any pronoun used in this agreement shall include the corresponding masculine, feminine, or neuter forms and the singular form of nouns, pronouns and verbs shall include the plural and vice versa. This Agreement shall be binding upon the parties hereto, their heirs, successors, assigns, and personal representatives, and any references to the Author or to Atlas Games shall include their heirs, assigns, successors, and personal representatives. This Agreement shall not be subject to change or modification in whole or part, except by a written document signed by the party against whom enforcement is sought.

Submission constitutes an Agreement between the photographer (hereinafter called "Photographer") and Trident, Inc. d/b/a Atlas Games (hereinafter called "Atlas Games"), whose principal place of business is at 885 Pierce Butler Route, St. Paul, MN, 55104, with respect to your photographs (hereinafter called the "Photographs") for "40 Years of Gen Con" (hereinafter called the "Title"), the working title of a non-fiction book.

Photographer warrants to Atlas Games that the Photographs are innocent and contain no matter contrary to law and that Photographer has not made any prior commitments in conflict with this Agreement. Photographer warrants further that the Photographs do not infringe upon any statutory copyright, common law right, right of privacy, or proprietary right of any sort other than such rights of Atlas Games. Photographer will defend, indemnify, and hold harmless Atlas Games against all claims, suits, costs, damages, and expenses that Atlas Games may sustain by reason of any scandalous, libelous, or unlawful matter judged to be contained in the Photographs by a court of law, or any infringement or violation by the Photographs of any copyright or property right; and until such a claim or suit has been settled or withdrawn, Atlas Games may withhold any consideration due the Author under this Agreement.

Atlas Games agrees to indemnify and hold harmless Photographer against any and all claims, costs, and expenses, including attorney's fees, due to materials included in Photographs at the request of Atlas Games for which no copyright permission or privacy was requested, or for which uses exceed those allowed pursuant to a permission or release.

As consideration, Atlas Games agrees to provide the Photographer with one (1) copy of the Title within 30 days of its publication, for the following rights related to the Photographs: Publication of the Photographs in the Title; publication of the Photographs in advertising and promotional material for the Title and for Atlas Games in general; publication of the Photographs in subsequent reprintings, new editions, and foreign translations of the Title; and re-use of graphic elements in later publications of Atlas Games.

Atlas Games will have the right to develop and otherwise alter the Photographs. Atlas Games will have the right to publish the Photographs in the Title at its own expense in such style, form, and manner and at such price as it deems suitable. Contributor credit shall be given in the Title by Atlas Games to Photographer upon publication of the Title.

Ownership of the Photographs and all copyrights pertaining to it shall remain solely with the Photographer. All original copies of the Photographs supplied by the Photographer shall be returned to the Photographer in a timely fashion.

This agreement shall be construed and interpreted according to the laws of the State of Minnesota. This Agreement shall be binding upon the parties hereto, their heirs, successors, assigns, and personal representatives, and any references to Photographer or to Atlas Games shall include their heirs, assigns, successors, and personal representatives. GEN CON BADGE TERMS OF USE

The purchase of a Gen Con 2006 badge admits one person to all basic activities and exhibits at Gen Con 2006 (the "Event") during regularly scheduled hours for the day(s) it is purchased. Some designated activities require pre-registration and/or payment of a separate, additional fee.

In accepting this badge and in consideration for being admitted to the Event, the holder consents to being recorded (by audio, visual and/or other means) for exhibition and exploitation by any means in all media now known or hereafter devised worldwide in perpetuity. Holder also hereby: (1) Gen Con LLC from any liability for loss or damage to persons or property, infringement of any right, or any other claim or course of action of any kind; (2) authorizes and permits Gen Con LLC and its designees which include but are not limited to all sponsors, exhibitors and contractors to use and authorize the use of his/her name, voice, likeness, and all reproductions thereof by any means and in all media now and hereafter known for all purposes worldwide in perpetuity; and (3) agrees to comply with all the rules and regulations of the Event. Holder agrees not to make any recordings of any kind at designated activities without the express written permission of Gen Con LLC. We reserve the right to deny entry or remove from the Event facilities any person who in our sole and absolute discretion is behaving or threatening to behave in a manner which we reasonably consider to be disruptive of the Event.

This badge is non-refundable or exchangeable for any reason.
